Terms of Service

1. Acceptance of Terms

By accessing or using MyanMyanPay's services ("Services"), including our payment gateway, SDKs, Storefronts, POS systems, and APIs, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services.

2. Description of Services

MyanMyanPay provides payment processing infrastructure for businesses in Myanmar, including:

  • MMQR Payment Processing - Unified QR-based payment acceptance across multiple wallet providers
  • Cloud POS System - Point-of-sale solution with dynamic QR code generation
  • Merchant Storefront - Hosted online store with integrated payment processing
  • Developer SDK & API - Tools for custom payment integration

3. Merchant Eligibility

To use our Services as a Merchant, you must: be a legally registered business or individual in Myanmar; provide accurate KYC/KYB documentation as requested; maintain a valid bank account for settlement purposes; and comply with all applicable Myanmar laws and regulations, including those of the Central Bank of Myanmar.

4. Privacy and Data Security

By using our Services, you acknowledge that we process personal and financial data in accordance with our Privacy Policy. You agree to implement reasonable security measures to protect your account credentials and your customers' data. We utilize industry-standard encryption and comply with local regulations to ensure the safety of transaction data.

5. Fees and Payment

Storefront Plans

Storefront services are offered under tiered subscription plans (Free, Starter, Business, Enterprise) as detailed on our Pricing page. Plan features, limits, and pricing are subject to change with reasonable notice.

Developer API

Access to the Developer API is subject to an annual platform maintenance fee of 120,000 MMK per account. Additionally, API usage is billed on a per-successful-transaction basis with a flat fee of 100 MMK per transaction. There is no charge for failed requests, QR generation, or status checks.

Settlement

For security purposes and to prevent fraud, all incoming transactions are subject to a 24-hour holding period. After this holding period, funds will be available for withdrawal to your designated bank account, subject to processing times of partner financial institutions.

6. Refunds and Disputes

MyanMyanPay is a payment processor and infrastructure provider; we are not a party to the transactions between you (the Merchant) and your customers. You are solely responsible for:

  • Handling all customer support, returns, and refunds.
  • Providing accurate descriptions of goods and services.
  • Resolving any disputes regarding the quality or delivery of goods.

MyanMyanPay does not offer refunds on transaction fees for refunded transactions, except where required by law.

7. Prohibited Activities

You may not use our Services for any unlawful purpose, including but not limited to: money laundering or terrorist financing; sale of prohibited or restricted goods under Myanmar law; fraudulent transactions or misrepresentation; or any activity that violates the regulations of the Central Bank of Myanmar.

Strict Prohibition on Sub-Merchants and Payment Aggregation

You are strictly prohibited from using MyanMyanPay's infrastructure to act as a payment intermediary, aggregator, or service bureau. You may not use our Services to set up your own payment system, gateway, or network of "sub-merchants." Our Services must only be used to process payments for your own direct customers.

Any attempt to resell, white-label, or process payments on behalf of third-party businesses will result in the immediate revocation of your API keys, permanent termination of your account, and potential freezing of associated funds.

8. Account Suspension and Termination

We reserve the right to suspend or terminate your account immediately if we reasonably believe you are in violation of these Terms (specifically including the prohibited activities outlined in Section 7), or if required by law or regulation. Upon termination, any pending settlements will be processed according to our standard settlement schedule, minus any applicable fees or chargebacks.

9. Limitation of Liability

MyanMyanPay shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services. Our total liability for any claim shall not exceed the total fees paid by you to MyanMyanPay in the twelve (12) months preceding the claim. We are not liable for delays or failures caused by third-party payment providers, banks, or force majeure events.

10. Intellectual Property

The MyanMyanPay platform, including our APIs, SDKs, Storefront designs, documentation, and logos, remains the exclusive property of MyanMyanPay. We grant you a limited, non-exclusive, non-transferable license to use our Services solely for the purpose of accepting payments and managing your store as described in these Terms.

11. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated via email or dashboard notification at least 30 days before taking effect. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

12. Governing Law and Language

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Union of Myanmar. Any disputes shall be resolved through the courts of Yangon. These Terms may be available in multiple languages; in the event of any conflict or inconsistency, the English language version shall prevail.
